Kithier drops lawsuit.

The lawsuit is over.

Thomas Kithier and his family has voluntary dismissed his lawsuit against the MHSAA and Macomb Dakota officials on Thursday.

The family sought a restraining order giving Kithier a chance to play at Clarkston but was denied on two fronts, one by the MHSAA and the other in Federal Court.

Kithier transferred to Clarkston from Macomb Dakota last summer however Macomb Dakota filed a complaint with the MHSAA saying that the transfer was athletically motivated and wasn’t academically motivated like the Kithier family and Clarkston mentioned. The MHSAA agreed with Macomb Dakota’s request and denied Kithier eligibility to play because of its “links rule” in which they found that there was enough evidence linking Kithier with teammate Foster Loyer on an AAU team.

Kithier is a Michigan State recruit.

Kithier thanked his family, the basketball world, and his attorneys for fighting beside him to try to get him a chance to play for the Wolves this season but it wasn’t meant to be.

Kithier has been allowed to practice with the Wolves during this whole process.

The MHSAA transfer rule has been in place since 1997 but the links rule has been in place a few years ago.

It will be interesting to see if this case has an impact on future transfers down the line.
